Terms and Conditions

The following terms and conditions of the version in force at the time of the order exclusively apply to all business relations between Magnetix Wellness GmbH, hereinafter the Magnetix Wellness GmbH group, and the customer. Following rules are solely to effect terms and conditions as amended at the time of the order. Contrary conditions are not acknowledged, except if a prior written approval has been given.

Magnetix Wellness GmbH exclusively concludes order-contracts with:
1. Unrestricted, legally competent persons of absolute legal capacity who have reached the age of 18 years or over.
2. Legal entities
With the dispatch of an order, the person purchasing a product from Magnetix Wellness GmbH automatically declares that the above conditions have been met.

The order of the client to Magnetix Wellness GmbH is an offer tmade to us to conclude a purchase contract. We confirm the receipt of the order by sending an e-mail to the e-mail address which you have stated on your order form. This e-mail specifies the ordered articles once more with its individual and total costs, packing- and shipping costs accruing and the total amount of the order. The purchase contract comes to effect with the shipment of the ordered goods to the specified address.

You can return the purchased good(s) within two weeks – 14 days - without any particular reason. Commencement of this term starts with the receipt of the good(s), in combination with the recognition of this instruction. In order to abide by the contract, dispatch the article(s) in good time prior to the deadline.

§ 5. Prices

The offered prices for the articles in our shop are expressed in EURO, USD, GBP or CHF according to the country of delivery and apply to each article. The prices apply which are found at the time the order is placed. All prices apply from the company headquarters including statutory value added tax and excluding packaging and shipping costs..

In the case of faulty conveyance to an incorrect address, we reserve the right of charging you for any costs arising from the return consignment of your package. The same applies when a default of acceptance takes place.

Delivery of cargo shipment takes place Monday to Friday. In case the billing address deviates from the delivery address, please advise us when placing your order. Please check directly upon receipt of goods, whether or not the packages have been damaged and whether or not you have received the correct products in the correct quantity. If you find a delivery is wrong or damaged, please do not omit to obtain a receipt from the deliverer and afterwards, contact us immediately. Your statutory warranty rights are not affected by this.

Magnetix Wellness GmbH reserves ownership of all goods it supplies to a customer until final and complete payment of the purchase price has been made. If third parties seek to assert rights over the goods which are subject to reservation of ownership, the purchaser will refer to Magnetix Wellness GmbH ownership and immediately inform the latter. If the purchaser falls into payment arrears or if he fails culpably to fulfil other basic liabilities, Magnetix Wellness GmbH reserves the right to withdraw from the contract as set out in articles; 323, 440 of the German Civil Code (BGB) and to demand recovery of the goods subject to reservation of ownership or, if applicable, to demand assignment of the purchaser's claims for recovery vis-a´-vis third parties.
Magnetix Wellness GmbH warrants that the supplied products are free of material defects at the time of transfer. For all defects in the goods occurring during the statutory warranty period, you can choose from the statutory entitlements of subsequent fulfilment, rectification of defects/replacement as well as -provided the statutory basis exists - further reaching claims for abatement or withdrawal and alongside this, compensation for loss, including compensation for loss instead of fulfilment and compensation for your wasted expenditures.

Magnetix Wellness GmbH only bears liability in cases where a legal representative or a vicarious agent is found of premeditated or gross negligence. A loss arising from death or injury to body and/or health, the amount of liability is restricted to the estimated value at conclusion of contract

Magnetix is obliged to exclusively use and store the information (such as name, address, payment method, etc.) of its customers electronically for purposes such as handling the incoming purchase contracts and for informing customers. An exception of this is made when customer information is passed on to third parties (for instance couriers or credit institutions) for the purpose of contract fulfilment. As soon as the preceding reason for storing your information no longer applies, you have the right to retrieve your information, have it amended or deleted at any time.
Magnetix Wellness GmbH will observe all requirements under the data protection law, in particular the conditions imposed by the Teleservices Data Protection Act (TDG). The customer consents to the storage and forwarding of his personal information in the context described above.

German law applies to the legal relationship between Magnetix Wellness GmbH and the purchaser as well as to the respective terms and conditions. Place of jurisdiction for both parties is - as far as permitted by law – Frankfurt a.M., Germany. If the consumer is not registered in the European Union, the law of the place of residence of the end user may also apply (as far as mandatory provisions under the consumer law are concerned). The purchaser has no right to offset unless the claim is not in dispute or has been determined with legal effect by a court of law. In such a case, the place of fulfilment for deliveries and payments and the place of jurisdiction is Frankfurt a. M. .
The colours of the products shown on the Internet may differ from the originals for various reasons (including monitor settings, quality of graphic cards, etc.).
If one of the above provisions is or becomes invalid, the validity of the remaining provisions is not affected.
